Terms of service
The rules between you and Orbita: accounts, content, rights, plans and liability.
Orbita has just launched and is currently run by a private individual based in Riedenburg, Germany. There is no registered company yet: once invoicing starts, a company will be incorporated and these documents will be updated with the legal name, register, VAT number and full address.
1. Who runs Orbita
Orbita is operated by Paolo Sodo, 93339 Riedenburg, Germany, reachable at hello@streamorbita.live.
The project has just launched and is not yet a registered company. Once invoicing begins, a company will be incorporated and will take over these terms; we will notify you in advance.
2. What the service offers
Orbita provides a public creator profile and tools to announce and publish premieres, content and events for your audience.
Orbita supplies technical tools: it does not produce creators' content and grants no rights over third-party works.
3. Accounts and verification
To register you need a valid email address and must confirm it via the link we send. You must be at least 16 years old.
You are responsible for keeping your credentials confidential and for activity carried out with your account.
4. Becoming a creator
Publishing is reserved for approved accounts. Applications are reviewed manually and may be accepted or declined without an obligation to give reasons.
Approval can be revoked in case of breaches of these terms or substantiated third-party rights complaints.
5. Content and rights
By publishing content you confirm that you are its author or hold all necessary permissions, including for music, images and third-party material.
You keep ownership of your work and grant Orbita a limited, non-exclusive, royalty-free and revocable licence to host, display and promote it within the service.
Orbita's brand, interface and software remain the property of the operator.
6. Prohibited content
Illegal content, copyright or trademark infringement, hate speech or incitement to violence, sexual material involving minors, third-party personal data published without a legal basis, spam and fraud are prohibited.
Unauthorised stream redistribution, circumvention of technical protection measures and disallowed automated use of the platform are also prohibited.
7. Reports and moderation
Anyone can report content by writing to hello@streamorbita.live with the URL and the reason.
We review reports and may remove content, suspend accounts or revoke creator status. Affected users receive a reason and may respond.
8. Plans, commission and payments
The Base plan is free: transactions handled through Orbita carry a 15% commission to Orbita, with 85% going to the creator.
The Pro plan costs €29 per month and removes Orbita's commission; payment provider fees still apply.
Payments are handled by Stripe. Until the company is incorporated and tax setup is complete, payments may stay disabled or in test mode; no amount is charged during that period.
9. Renewal and cancellation
The Pro subscription renews monthly until cancelled. You can cancel any time from the subscription page; access continues until the end of the paid period.
10. Service availability
Orbita is a young, evolving project: we do not guarantee uninterrupted availability and may change or suspend features, giving notice where the change is material.
11. Liability
We are liable without limitation for intent and gross negligence, and for damage to life, body and health.
For slight negligence we are liable only for breach of essential contractual duties, limited to typical and foreseeable damage.
We are not liable for content published by creators or for relationships between creators and their audience.
12. Closing an account
You may close your account at any time. We may close an account with reasonable notice, or immediately in case of serious breaches.
13. Changes to these terms
Material changes will be announced at least 30 days in advance by email. If you do not accept them you can close your account before they take effect.
14. Governing law
German law applies. If you are a consumer, the mandatory protections of your country of residence remain unaffected.
